This article examines the general power of enforcement set forth in Article 139, IV, of the 2015 Brazilian Code of Civil Procedure, focusing on the relationship between the effectiveness of judicial protection and the safeguards afforded to the judgment debtor. It starts from the conception of an effective process as one capable of implementing, in concrete terms, the right recognized in court, and then analyzes the expansion of judicial powers in the adoption of atypical coercive measures. The absence of detailed statutory regulation regarding the requirements and limits of such measures has created an area of uncertainty, subsequently addressed by legal scholarship and by the Superior Court of Justice. In this context, Repetitive Theme 1137 performs a structuring role by conditioning the use of atypical enforcement measures on the cumulative observance of subsidiarity, proportionality, reasonableness, least onerous means, adversarial proceedings, and adequate reasoning. The article seeks to systematize material, formal, and temporal criteria to guide the exercise of this judicial duty-power in the application of atypical coercive measures.
