The judge of guarantees and the accusatory system in Brazil

Abstract

This article analyzes the judge of guarantees as a mechanism for implementing the accusatory system in Brazilian criminal procedure, focusing on its relationship with judicial impartiality and on the separation of the functions of investigating, prosecuting, and judging. The study is based on the research problem of whether this institution represents a mere legislative option for procedural reorganization or whether it constitutes a requirement compatible with the constitutional order established in 1988. Bibliographical and documentary research was conducted through the analysis of the Federal Constitution, the Code of Criminal Procedure, Law No. 13,964/2019, the Federal Supreme Court decisions in ADIs 6298, 6299, 6300, and 6305, and CNJ Resolution No. 562/2024. The findings indicate that, although the accusatory system is formally recognized in Brazilian law, inquisitorial remnants still persist, especially due to the concentration of judicial functions during the investigative phase. It is concluded that the judge of guarantees constitutes an important instrument to strengthen impartiality and promote democratic coherence in criminal procedure, although its effective implementation depends on adequate administrative structure, efficient regulation, and institutional adaptation.
