Abstract

This article analyzes the evolution of Stable Union (União Estável) within the Brazilian legal system, as well as the understanding of the Higher Courts regarding the peculiarities of the human relationships developed. It further examines several decisions by the Superior Court of Justice (STJ), notably REsp 2.203.770-GO, published in Case Law Gazette (Informativo) No. 873, which mitigates the requirements necessary for its characterization to ensure due constitutional protection. The study examines the need to provide effectiveness to the institute, which, at times, will imply differentiated treatment justified under the perspective of proportionality and the prohibition of deficient protection.
