Abstract

This article analyzes the dogmatic challenges of delimiting criminal authorship in Brazilian Environmental Criminal Law, focusing on the application of art. 2 of Law No. 9,605/1998. Given complex corporate structures, it investigates how Claus Roxin's functionalist theory offers normative criteria to avoid objective criminal liability of managers. The research confronts the interpretation of the Superior Court of Justice (STJ), which requires the individualization of conduct and proof of the causal link, with decisions from lower courts that still apply punishments based solely on the position held. It concludes that the application of objective imputation criteria and the theory of the guarantor are fundamental for the rationality of the environmental punitive system.
